Patricia E. Lowry is a Fellow in the American College of Trial Lawyers and focuses her practice on product liability and employment litigation, with expertise in pharmaceutical defense. She has more than 20 years' experience defending cases involving prescription medications, over-the-counter products and medical devices. Pat also defends consumer fraud and marketing product claims, including putative class actions, and is experienced in defending pharmaceutical whistleblower actions.

Prior to her career in private practice, Pat was a judicial law clerk to the Honorable José A. Gonzalez Jr. of the US District Court, Southern District of Florida.

  • In 2013, successfully argued for dismissal of a whistleblower qui tam False Claims Act case alleging off-label promotion of prescription medications and illegal kickbacks to physicians. Dismissal affirmed on appeal.
  • Served as Florida counsel for consolidated state court cases alleging personal injuries from the off-label administration of a medication processed through a compounding pharmacy.
  • Serving as national counsel, MDL defense liaison counsel, and a member of the trial team in the Trasylol© litigation since 2008.
  • Obtained summary judgment in a Florida state court breach of contract action relating to a significant patent infringement action regarding one of the most widely used prescription medications.
  • Served as trial counsel and Florida regional counsel in the Vioxx® litigation, receiving a defense verdict from a state court jury in Tampa, Florida in October 2007, the last case to be tried before the announcement of a global settlement.
  • Served as trial counsel, Florida counsel and a member of the national trial team in the phenylpropanolamine (PPA) litigation defense, receiving a defense verdict from a Florida state court jury in Sanford, Florida.

  • Served as Florida trial counsel and Florida regional counsel in the OxyContin® litigation defense, receiving a defense verdict in a federal trial in Tampa, Florida on a whistleblower claim brought by a former sales representative.
  • Served on the national trial team and as South Florida regional counsel to a medical device company in orthopedic bone screw litigation.
  • Served as trial counsel and Florida regional counsel for the Dalkon Shield Claimants Trust, receiving a defense verdict in a Florida state court jury trial in West Palm Beach.
  • Served as trial counsel and Florida regional counsel in the defense of blood product litigation for more than a decade, receiving a defense verdict before a federal jury in Miami.
  • Lead Florida counsel for a healthcare company in a significant market share case heard by the Supreme Court of Florida.
  • Obtained voluntary dismissal of a significant rollover paraplegic personal injury action against the manufacturer of vehicle safety systems.
  • Obtained numerous jury verdicts, summary judgments, and dismissals of employment cases involving claims of retaliation, sexual harassment, discrimination based on gender, age, religion, disability, and race discrimination, and Equal Pay Act claims.
  • Won defense attorneys’ fees in federal employment discrimination cases.
  • Obtained reversal by the Eleventh Circuit Court of Appeals of an adverse jury verdict in a case tried by other counsel.
