Radical Changes for Foreign Investment in China are on Their Way

On January 19, 2015, the PRC Ministry of Commerce released a draft Foreign Investment Law (the “Draft FIL”) for public comments. If adopted, the Foreign Investment Law will replace the three primary laws that currently apply to foreign-invested enterprises (the “FIEs”) since 1979, i.e., the Wholly Foreign-owned Enterprise Law, the Sino-foreign Equity Joint Venture Enterprise Law and Sino-foreign Cooperative Joint Venture Enterprise Law (collectively, the “Existing FIE Laws”) and will dramatically and fundamentally change the regulatory regime for foreign investment in China. The key highlights of the Draft FIL are summarized in our publication.
