Carlton Daniel is a partner in our intellectual property and technology team based in our London office. His practice incorporates the full range of specialist advice in the advertising, marketing and media sectors and he handles both contentious and non-contentious matters. His practice ranges from advising on intellectual property rights (including trade marks, designs, copyright and confidential information) to commercial contracts, licensing, brand endorsement, sponsorship, product placement, privacy, defamation, confidentiality, data compliance and advertising clearance.

As part of his specialist offering to the marketing services sector, Carlton's expertise encompasses advice on agency appointments, media buying, digital campaigns (e.g. issues involving social media/user generated content, email and viral marketing), gambling law advice for marketing with competitions, sweepstakes and prize draws, dealing with the courts and other advertising/consumer protection regulators such as local trading standards services, the Advertising Standards Authority, the Information Commission's Office and Ofcom. Carlton also deals regularly with the OFT in relation to regulatory matters.

Carlton is a rising star in the advertising and marketing field and frequently speaks at industry conferences. Carlton’s practical and commercial approach is bolstered by having spent time on secondment at BT plc, BP plc and Birds Eye.

  • Advising several agencies within the WPP plc group on various high-profile global agency appointments and advertising campaigns including with international investment and retail banks, global tobacco manufacturers and distributors, airlines, insurers, pharmaceutical giants and alcoholic drinks brewers and suppliers.
  • Successfully acting for Fuller Smith & Turner plc, to secure a complaint "not upheld" ruling from the ASA when a competitor sought to ban a high-profile advertisement to "support English rugby".
  • Advising Signet Trading (H Samuel, Leslie Davies and Ernest Jones), the biggest retail jewellery group in the UK, on advertising and marketing matters including pan-European regulatory compliance and Signet's contracts with its marketing agencies.
  • Advising a large car franchise and an international entertainment and ticket sales company in relation to investigations by the OFT into possible breaches of the Consumer Protection from Unfair Trading Regulations and the Unfair Terms in Consumer Contracts Regulations.

The company was advised on a complex matrix of laws in multiple jurisdictions coordinated centrally and efficiently.
