Scott Kane serves as the co-chair for the firm’s Litigation Practice. He is a trusted counselor to business leaders, boards of directors, in-house counsel, public officials and other clients. A skilled lawyer with extensive experience handling complex disputes, the strategic and business goals of Scott’s clients are always top of mind. Scott assists clients in developing strategies for avoiding or minimizing legal disputes whenever possible.

When disputes cannot be avoided, Scott employs a strategic approach to litigation to aggressively protect clients’ interests but also to achieve cost-effective resolutions that serve the business objectives of his clients. When necessary, this includes defending those interests at trial.

Scott has been recognized for his litigation skills and client service by organizations like The Best Lawyers in America (for Bet-the-Company and Commercial Litigation), Chambers USA, Ohio Super Lawyers (including its Ohio Top 100 lawyers list) and other professional organizations. He has represented clients in courts and arbitration proceedings across the US in a variety of industries, including financial services, manufacturing, consumer products, technology, professional services, and design and construction. He also has significant experience representing both debtors and creditors in disputed matters in large Chapter 11 cases and other bankruptcy-related litigation.

In addition to his litigation practice, Scott leads our eDiscovery & Data Management team and taught electronic discovery law for many years as an adjunct professor at the University of Cincinnati College of Law. Prior to law school, Scott served in the United States Army and is a veteran of Operation Desert Storm.

  • Representing a special litigation committee of the board of directors of a casino gaming company concerning its independent investigation of potential claims arising from a US$8.9 billion leveraged buyout transaction.
  • Successfully defending a financial institution against class action claims by removing the case under the provisions of the Class Action Fairness Act and then obtaining dismissal of all claims in federal court.
  • Successfully defending a publicly traded client against putative class actions filed in federal courts around the country, including obtaining an order striking class action allegations at the pleading stage.
  • Serving as lead trial counsel for a group of Chapter 11 debtors in a case involving more than US$2 billion of claims including successfully defending the debtors’ plan of reorganization against objections by state environmental agencies, the US and private creditors.
  • Successfully representing a national banking association in complex litigation involving receivership and foreclosure on commercial real estate located throughout Ohio.
  • Successfully resolving multimillion-dollar cost overrun claims against a team of design and engineering firms concerning the construction of a National Football League stadium.
  • Advising the Official Committee of Unsecured Creditors of Enron Corp. regarding nationwide discovery issues and coordination of multi-firm, multijurisdictional matters involving tens of millions of pages of discovery documents.
  • Leading an internal investigation for the audit committee of a client regarding alleged wrongdoing by senior officers of a financial services company.
  • Serving as outside general counsel to a development and asset management organization whose board consists of CEOs of large public and private companies and other community leaders.
