Michele Munk
Senior Attorney
Michele Munk is a litigator and regulatory lawyer. Her regulatory practice specializes in a variety of industries, including healthcare, pharmacy and public utilities. She has also represented clients at federal and state court trials, and on appeal, in administrative proceedings and in arbitration and mediation. Michele has also counseled clients on compliance with laws governing information privacy and security.
Michele’s practice blends regulatory and litigation activities. Her regulatory practice in healthcare has involved more than 100 disputes involving managed care and compliance with state and federal laws. She has represented public utilities in dozens of disputes and regulatory filings before state public utility commissions. Her nationwide litigation experience includes multidistrict litigation and class actions in federal and state courts in Ohio and throughout the US.
Prior to graduating, Michele interned for the Honorable James L. Graham of the US District Court for the Southern District of Ohio. Prior to joining the firm, she worked for a national firm in Columbus, Ohio.
- Representation of companies in arbitration concerning a variety of managed care disputes, including pharmacy and provider terminations, claims and allegations of fraud, waste and abuse, breach of contract and payor disputes.
- Advising health insurers on Medicare Advantage and Part D compliance.
- Counseling on compliance with the full range of state and national laws and regulations including HIPAA, FCRA, FACTA, ECPA, FOIA, and others.
- Representing companies in litigation growing out of data security incidents and cybercrimes, including federal and state Wiretap Act, Computer Fraud and Abuse Act, and Stored Communications Act.
- Representing telecommunications companies in complex litigation and regulatory proceedings before the Public Utilities Commission of Ohio involving rate-setting methodologies and disputes, joint use and pole attachment issues, and quality of service complaints.
- Representation of automotive manufacturers in defense of numerous actions alleging product defect, and involving wrongful death and survivorship claims.
- Defended employers on charges of discrimination, FMLA violations, and retaliation claims litigation in federal and state courts, as well as administrative agencies.
- Representation of Ohio rural electric cooperatives in tort litigation involving personal injury or death.
- Successfully prosecuted 42 U.S.C. §1983 and common law fraud claims against government agency.
- Representation of landlords in various commercial leasing disputes and eviction actions; representation of commercial tenants in commercial leasing disputes.
- Representation of various corporations in complex contractual disputes.
- Successfully prosecuted and defended numerous actions for injunctive relief relating to restrictive covenants and non-competition agreements.
- Representation of criminal defendant in appeal from conviction for insider trading and conspiracy, and in settlement of related SEC civil action.
