Harassment, intimidation and bullying incidents in schools have been receiving extensive media coverage over the past few months. School districts are being caught by the media for noncompliance with the obligations to report these incidents on district websites. As a reminder, Ohio Revised Code Section 3313.666(B)(10) went into effect in 2007. It requires that the district administration provide a semiannual report to the Board of Education that includes a written summary of all reported incidents of harassment, intimidation or bullying. The summary must be posted on the district’s website, if any, to the extent permitted by Ohio Revised Code Section 3319.321 and the Family Educational Rights and Privacy Act of 1974.
If you have not already done so, it is important to prepare this required report immediately, provide it to the Board and post it on the district website to the extent required by law. If you have questions about these reporting and posting requirements or need assistance in creating the required report, please contact your primary Squire Sanders lawyer or one of the individuals listed in this Alert.
