The EEOC has revised its "Equal Employment Opportunity is the Law" poster to reflect recent changes in federal employment discrimination law including the passage of the ADA Amendments Act of 2008 (ADAAA), which went into effect on January 1, 2009, and the enactment of the Genetic Information Nondiscrimination Act of 2008 (GINA), which went into effect on November 21, 2009.

Employers can comply with federal posting requirements by doing one of the following through the EEOC website:

    1. Printing the supplemental poster and posting it alongside your current "Equal Employment Opportunity is the Law" poster.
    2. Printing and posting the EEOC’s new version of the "Equal Employment Opportunity is the Law" poster.
    3. Ordering a new poster through the EEOC Clearinghouse and posting it at the worksite. Please note that the EEOC has indicated the new poster is on backorder and will be shipped once it becomes available.
These notices should be placed in conspicuous places throughout the worksite.

For further information regarding the changes and federal posting requirements, please contact your principal Squire Sanders lawyer or one of the individuals listed in this Alert.
