In this article appearing on, Squire Sanders partner Scott A. Kane, co-chair of the E-Discovery & Data Management Team, discusses e-discovery and how to insure that this often very expensive element of litigation is done both diligently and efficiently. Mr. Kane suggests a strategy that involves an internal e-discovery system that enables a large volume of documents to be reviewed, while establishing protocols for the company's method for initiating and communicating litigation holds, preserving potentially relevant electronically stored information, and defining roles and responsibilities for the legal and IT departments for satisfying e-discovery responsibilities when they arise.
