    Squire Sanders partners James J. Barresi and Stephen D. Lerner and associate Andrew M. Simon co-authored “Options for Selling Distressed Assets,” published in the March 2011 issue of Financier Worldwide Magazine. Their article addresses several asset sale vehicles including out of court sales and secured party sales, bankruptcy sales, receivership sales and assignments for the benefits of creditors, which are becoming increasingly popular for facilitating financial restructurings. The authors discuss some of the benefits and risks associated with each sale method and the competing considerations debtors, creditors and prospective buyers should weigh before structuring an acquisition of distressed assets.
