“Market Data Supply Agreements,” co-authored by Squire Sanders lawyers Brian N. Hartnett, Diarmuid Ryan and Nikos Dimopoulos has been published in Global Competition Review’s The European Antitrust Review 2012. The article highlights some of the key considerations for businesses seeking to maintain a competitive edge through up-to-date market data while avoiding infringement of EU competition rules. The authors provide an overview of recent cases finding information exchange violations, with and without the presence of collusive behavior, and the implications for future application of the competition rules. They also discuss the impact of the European Commission’s new set of guidelines, including a new section on information exchange, for the assessment of cooperation agreements between competitors.
