During the last three years, the Secretary of Labor has lived up to her self-described “new cop on the street” persona. Industry readers have not been surprised to see that enforcement and penalties at MSHA and OSHA have increased significantly. What may be shocking, however, is the expansion of MSHA and OSHA’s power through “executive fiat” by all levels of the agencies, and by their inspectors in the field. No better example exists than MSHA’s recent abuse of its closure order powers.
