TECHNOLOGY AND COMMUNICATIONS CLIENT ALERT: FCC Undertakes Review of Program Access Rules

    On March 20, the Federal Communications Commission (FCC) released a Notice of Proposed Rulemaking (NPRM) seeking comment on whether to sunset or relax one of the several protections afforded to multichannel video programming distributors (MVPDs) under the FCC’s program access rules, that being the prohibition on exclusive contracts involving satellite-delivered, cable-affiliated programming. Additionally, and perhaps of greater interest to competitive MVPDs, the NPRM also seeks comment on potential revisions to the program access rules to better address alleged violations.
