Superfund and Natural Resource Damages Litigation: 2011 Annual Report

    Congress enacted no changes to CERCLA during 2011. The administrative developments important to superfund practitioners primarily concerned the National Priorities List (NPL) and possible  changes to the Hazard Ranking System (HRS) used to place sites on the NPL. EPA placed twenty-five new sites on the NPL and proposed to list twenty-six more. Throughout the year, EPA periodically proposed deleting portions or entire NPL sites based on completion of work and attainment of cleanup standards, as the facts warranted, but fewer sites were deleted than added. EPA also sought input about changing the HRS scoring system to address vapor intrusion hazards, particularly as they relate to vapor intrusion into structures.
