Redundancy: No Reduction in Headcount is Required

    Must there be a reduction in actual employee numbers for there to be a statutory redundancy situation? Not necessarily, according to the EAT in Packman (t/a Packman Lucas Associates) v Fauchon. This decision may come as a surprise to some employers and means they should take care when seeking to reduce employees’ hours of work in response to a slowdown in business, as this may trigger the right to a redundancy payment in certain circumstances.
