UK Pension Regulator’s Overseas Reach: Storm in a Teacup?

    Regular readers of the Insolvency and Restructuring International journal will be familiar with the UK Pension Regulator’s (‘Regulator’) efforts to exercise its so-called ‘moral hazard’ powers against non-UK entities. This article re-examines some of the cases to date and considers the implications of the latest developments; considers the import of the Regulator’s recent statement on the manner in which it exercises its powers; and considers the impact on cross-border insolvency proceedings.
