INTELLECTUAL PROPERTY CLIENT ALERT: Patents Subject to Disclaimer Deemed Unenforceable if Owned by Different Subsidiaries

    The U.S. District Court of Nevada declared a patent unenforceable, finding that patents owned by different subsidiaries of the same company are not “commonly owned” under a terminal disclaimer. See Email Link Corp. v. Treasure Island, LLC, Case No. 2:11-cv-01433-ECR-GWF, Dkt. No. 88 (D. Nev. Sept. 25, 2012).
