UK Government Announces Implementation Dates for Employment Reforms

    The Enterprise and Regulatory Reform Bill received Royal Assent on 25 April 2013 and the Department for Business, Innovation & Skills has now issued a press release setting out the dates on which some of the changes contained in the Act will come into force.

    The following provisions will come into force on 25 June 2013:

    • New provisions on whistleblowing, including a requirement for a claimant to show that a disclosure was “made in the public interest”, the removal of the “good faith” requirement for a protected disclosure and the introduction of vicarious liability for employers for the actions of their employees and agents.
    • New Employment Tribunal Rules – although these have yet to be finalised.
    • Removal of the 2-year qualifying period for unfair dismissal claims where the main reason for dismissal is the employee’s political opinions or affiliation.

    We are still waiting for confirmation as to when the other employment-related provisions in the Act will come into force.
