A Brief Review of Reinsurance Trends in 2013 (Westlaw Journal)

    The year 2013 brought us an important case from the New York Court of Appeals on “follow the settlements” in the context of allocation, which introduced an objective reasonableness standard. It also brought us a series of late-notice defense cases. Courts also exhibited a continued willingness to stay litigation and compel arbitration where the dispute fell squarely within the scope of the relevant arbitration clause.
