Adidas Successful in Three-stripe Opposition Case

    The Court of Justice of the European Union (CJEU) has upheld an opposition by international sports company Adidas to an application to register two parallel lines positioned on footwear as a Community Trade Mark. The CJEU held that the overall impression produced by the sign was similar to that produced by Adidas’ famous three stripe trade mark. The decision will make it more difficult for Adidas’ competitors to use stripe variations on shoes and the addition or omission of a single stripe alone is unlikely to be found sufficient to avoid a likelihood of confusion with Adidas’ trade marks.
