Posting of Employees to Poland in the Framework of Provision of Services

    On 18 June 2016, new legislation came into force in Poland regarding the posting of employees in the framework of the provision of cross border services. The new rules result from the obligation to transpose EU Directive 2014/67/EU, dated 15 May 2014, into Polish law.

    In addition to general obligation of making sure that any posted foreigners enjoy conditions of employment in line with Polish labour regulations, new obligations have been imposed on employers posting their employees to Poland, including the appointing of a contact residing in Poland. Short deadlines to ensure compliance with the new regulations have been set for those who have posted their employees to Poland on, or before, 18 June 2016.
