New South Wales Government to Massively Increase Penalties for Developers That Fail to Comply With Defect Bond Scheme

    Proposed changes to the Strata Schemes Management Act 2015 (NSW) (Act) mean that developers face significantly increased penalties for failing to comply with the recently introduced strata defects bond scheme, which was designed to secure the rectification of defects in newly constructed strata buildings.

    The proposals seek to significantly enhance the powers available to the government to enforce compliance, including by providing government officers with powers to compel production of documents and information relevant to determining whether offences against the Act have occurred.
