DOJ’s Slumping FCA Hauls Cloud Future Recovery Prospects

    The US Department of Justice’s lackluster performance in 2018 in False Claims Act (FCA) litigation marked its second consecutive year of slumping recoveries. Many wonder whether the DOJ can “revive its glory days” of blockbuster FCA hauls.

    In the January 12, 2019, Law360 report, senior associate Rebecca Worthington noted that “It would be simplistic to conclude from [2018’s] totals that false claims recoveries may be modest going forward. A particular year may be higher or lower depending upon variables like the settlement date of a large investigation.”
