“The House Makes the Call” The Federal Court of Australia Orders Override of Express Confidentiality Obligations in Crown Resorts Class Action

    In the context of the class action currently against Crown Resorts, the Federal Court of Australia recently ordered that the express obligations of confidentiality included in Crown’s employment contracts be overridden in order to assist the resolution of the dispute. In the midst of competing public policy issues, the Full Federal Court will have the opportunity to determine whether the court is permitted to override private contracts for the benefit of related proceedings when the matter is heard on appeal on 29 August 2019. On what basis, however, did the primary judge order for the employment contracts to be overridden in the first place?
