Squire Sanders Clients Leadscope, Inc. and Its Founders Prevail in American Chemical Society’s Appeal of Multimillion-Dollar Award

    An Ohio appellate court has upheld the US$34.4 million award, including US$7.5 million in punitive damages and US$7.9 million in fees and expenses, made to research software provider Leadscope, Inc. and its three founding scientists.

    The company and founding scientists Paul Blower, Glenn Myatt and Wayne Johnson have been embroiled in the trade secret misappropriation case for eight years. Global law firm Squire, Sanders & Dempsey L.L.P. represented Leadscope, Inc. and its founders throughout the prolonged litigation.

    The Tenth District Court of Appeals of Ohio (Franklin County) issued a ruling June 15 denying all points of appeal raised by the American Chemical Society (ACS) against the defendants.

    ACS sued Leadscope and its three founding scientists in 2002, claiming Leadscope’s founders – all former ACS employees – had stolen trade secrets by patenting a software program for drug companies that dramatically shortens the process of developing new medicines. The case was tried in 2008 in the Franklin County Court of Common Pleas; jurors found no evidence of misappropriation, found ACS had brought its claim in bad faith and awarded Leadscope and its founders damages on their counterclaims for defamation, unfair competition and tortious interference following an eight-week trial.
