DC Partner Jay Darden was quoted in a New York Times piece regarding shield laws on May 30, 2014. When commenting on the case of a journalist who had been subpoenaed for notes and testimony identifying his confidential sources in a leak investigation, Mr. Darden claimed that even if the Department of Justice declines to imprison a reporter, the use of a subpoena for confidential sources presents a “danger to the First Amendment” by chilling journalists from being aggressive and sources from wanting to talk to them.
