Barnaby Austin is an associate in our Sydney Labour & Employment Practice Group. Barnaby advises on all aspects of employment law with a particular focus on workplace investigations over varied factual scenarios, including in relation to disciplinary issues, sexual harassment, bullying, discrimination, etc., reviewing, drafting and negotiating contracts, workforce restructures, human resource strategy implementation and management, and dispute resolution. Barnaby also advises and represents clients on industrial relations matters and in dealings with unions.

    • Workplace investigation for a multinational client involved in design, manufacturing and marketing in the transport industry. Conducted an investigation into various bullying complaints from an employee against their manager. Coinciding with the employee’s bullying complaints were performance-related issues that had been raised by the manager.
    • Workplace investigation for a multinational client involved in design and manufacturing in the construction industry. Conducted an investigation into various bullying and sexual harassment complaints involving multiple employees, overlapping claims and counterclaims, and complex factual scenarios.
    • Representing a client in the financial services industry in relation to various claims (including discrimination, harassment, bullying and other legislative breaches) made by a former employee. Negotiated a successful outcome before formal proceedings were commenced.
    • Representing a client in the building and construction industry in relation to enterprise bargaining with the CFMEU.
    • Representing various clients at the Fair Work Commission responding to unfair dismissal and general protections applications.
    • Advising various clients over a variety of transactions in relation to employment legal issues, strategy and risk reduction.
