Aaron Boschee counsels commercial clients in litigation, arbitration and debt restructuring, with a particular focus on debtor-creditor disputes, shareholder and director disputes, asset recovery and loss mitigation, real estate-based litigation, creditor-lien priority and fraud. Aaron applies extensive trial and negotiation experience to achieve success on behalf of a wide range of commercial clients.

    An experienced litigator, Aaron represents clients in a wide range of commercial disputes from prelitigation negotiations through trial and appeals. He also successfully represents debtors and creditors in adversary proceedings and contested matters in connection with Chapter 11 proceedings and has served as a consultant to investment funds and various media outlets regarding municipal debt restructuring.

    Aaron also serves as the Colorado Lawyers Committee Task Force chair and lead class counsel for the Taylor Ranch Litigation, a historic land-rights case, through which he coordinates the pro bono efforts of dozens of lawyers at numerous law firms throughout the region. Through those combined efforts, over 8,000 parcels of land have been adjudicated to have rights originally established as part of a Mexican Land Grant of the mid-1800s.

    Aaron worked full-time throughout law school, served as senior staff editor of the Denver University Law Review, achieved the highest grade in Bankruptcy Law and served as a judicial intern for The Honorable William D. Robbins in the Denver District Court.

    • Recovered over 80% of investment funds on behalf of clients whose money was taken in a Ponzi Scheme.  
    • Obtained debtor’s subdivision development rights on behalf of holder of US$18 million in defaulted promissory notes.
    • Obtained arbitration award in property owner’s favor to cover entire cost of repairing construction defects caused by developer’s deficient drainage system. 
    • Successfully defended general contractor against construction defect claims brought by the state of Colorado related to business park renovation through trial. 
    • Recovered over US$3.5 million in insurance proceeds on behalf of a commercial property owner related to construction defects caused by the insured. 
    • Obtained trustee’s deeds to over a dozen commercial properties on behalf of a national bank. 
    • Obtained imposition of a constructive trust in favor of a lender over a US$4 million property that the debtor fraudulently transferred to a family member.
    • Successfully established first priority agister’s lien on behalf of the second largest creditor in a Chapter 11 bankruptcy of a dairy farm.
    • Successfully negotiated a walk-away settlement on behalf of a gold mining company in an action by a creditor seeking to foreclose on over US$18 million in debt secured by patented and unpatented mining claims. 
    • Obtained a preliminary injunction and prejudgment writ of attachment against all assets of a large crane company on behalf of a national bank.
    • Successfully defended creditor from a preference action brought by a Chapter 7 bankruptcy trustee.
    • Quieted title to real property on behalf of a gold mining company under a color of title claim against the Bureau of Land Management.
    • Obtained dismissal of breach of fiduciary duty claims brought by shareholders against corporate director.
    • Negotiated walk-away settlement on behalf of a restaurant owner for liability under a commercial real estate lease.
    • Obtained summary judgment in favor of lenders for defaulted commercial promissory notes and guarantees in approximately 20 cases.
