Anne Chin is an associate in the Internal Dispute Resolution Practice based in our Darwin office with knowledge and experience in commercial, litigation and government.

    Prior to joining us, Anne acted for the Northern Territory of Australia, gaining in-depth experience working with various government agencies.

    • Experience in court litigation, including in the Federal Court, Northern Territory Supreme Court, Local Court and the Northern Territory Civil and Administrative Tribunal (NTCAT).
    • Experience in various litigation and dispute, including tort claims, debt claims, breach of agreements, administrative law actions, tenancy disputes and construction disputes.
    • Supporting clients to comply with disclosure requirements. This involved reviewing and redacting documents and providing advice on claims of confidentiality and legal professional privilege.
    • Reviewing, drafting and negotiating various agreements, including tender contracts, leases, licences and deeds.
    • Advising clients on risks, rights and liabilities under agreements, legislations and regulations.

    Debt Recovery

    • Successfully defended the Northern Territory in a small claims matter in the NTCAT.
    • Drafting letters of demand for payment of debts or damages.

    Negligence

    • Acted for the Northern Territory in defending medical negligence claims in the Supreme Court and settlement of claims.
    • Acted for the Northern Territory in defending a claim for approximately AU$1 million of property damage.

    Administrative Law

    • Assisted in providing advice to the Minister for Infrastructure, Planning and Logistics in respect of a judicial review application to quash the Minister’s decision to refuse an application for rezoning to allow for the development of the Gardens Parklands.
    • Advised clients on freedom of information requests.
    • Provided case management of appeal matter in the Local Court regarding the refusal of a taxi licence.
    • Represented the Director of CVSU in an appeal against the decision of the assessor under the Victims of Crime Assistance Act 2006 (NT).
    • Advised clients about procedural fairness in a disciplinary proceeding against an employee.

    Construction and Building

    • Drafted notices under s 24KA of the Native Title Act 1993 (Cth) regarding proposed construction works.
    • Representing the Registered Proprietors of the 10 Duke Unit Title Scheme (BC 2014/023) in the settlement of a claim for damages as a result of defective residential building.

    Other

    • Represented the Northern Territory in native title and Aboriginal land right claims.
    • Assisted the Northern Territory to comply with notices to give information requested by the Royal Commission into National Natural Disaster Arrangements and the Royal Commission into Violence, Abuse, Neglect and Exploitation of People with Disability.
