Stephen Cole is a director in our Litigation Practice Group based in our London office. He has extensive experience in litigation, mediation and expert determination. His primary focus is complex, high value High Court litigation and multi-jurisdictional disputes. Stephen also has experience with sports-related disciplinary proceedings.

Stephen is experienced in resolving dispute for clients in a wide range of sectors and industries including pensions, manufacturing, airlines, insolvency practitioners, sports, breach of warranty disputes and employment restrictive covenant issues.

  • Advising a UAE based company on a complex multi-jurisdictional dispute in the Islamic finance sector, involving both UK High Court litigation and related proceedings in the UAE and the BVI. The claim was brought to seek certain declarations in respect of various transactional documents providing for a variety of governing laws and has involved the obtaining/defending of a number of injunctions in each of the jurisdictions.
  • Advising an international power company in prosecuting a High Court follow on damages claim arising out of an adverse decision from the European Commission in the power cables sector.
  • Advising two international airlines in defending a complex, high profile High Court follow on damages claim arising out of an adverse decision from the European Commission in the air cargo sector.
  • Advising the former finance director of a PLC company who had been sanctioned by the [then] FSA in High Court litigation for significant damages following the PLC’s collapse.
  • Involved in an extensive review of an international bank’s documents in relation to regulatory investigations.
  • Acting for the joint liquidators of a company in the media industry in High Court litigation brought against them by multiple claimants following the disposal of certain assets. The claim was successfully defeated at a two-week trial, with significant costs orders and judgment on counterclaim awarded in favour of our clients. Additionally, the judge made findings in respect of a technical defence available to Insolvency Practitioners under section 234 of the Insolvency Act 1986, which have been covered by industry press.
  • Advising pension fund trustees in a dispute with the scheme administrator regarding significant levels of unpaid fees.
  • Advising pension fund trustees in relation to miscellaneous issues, including under/over payment of pension entitlement; internal dispute resolution complaints; ombudsman complaints.
  • Advising the liquidator of a company on its obligations when responding to a request for third-party disclosure.
  • Advising an advertising agency on issues arising as a consequence of a team move and breaches of various restrictive covenants, and other contractual and equitable obligations.
  • Advising an international logistics company in conjunction with Singapore counsel relating to a team move and related breach of restrictive covenants/fiduciary duty claims.
  • Advising a Formula 1 motor racing team in a dispute with one of its drivers.
  • Advising a premier league football club in connection with a dispute arising from a share purchase agreement.
  • Advising the participating employers in a large pension scheme upon the obtaining of a declaration from the court as to the true construction of a clause within the scheme deed and rules.
  • Advising a sports management company on various issues arising from the breach of an agreement granting it international television rights regarding a high-profile cricket tournament.
  • Providing advice on the expert determination of a dispute arising out of a share purchase agreement.
  • Advising the directors of Fund Distribution Limited, both in drafting the rules for distribution of the fund and day-to-day operations and interpretation of the rules throughout the period of its operation.
