Ashley Fletcher is an associate in our Construction & Engineering team.

    Ashley specialises in non-contentious advice, and primarily acts on large-scale development projects, development finance projects, and real-estate transactions.

    Ashley has broad experience across the construction and engineering sector, advising clients (principally developers and funders) on the full range of construction documentation and procurement methods, including D&B contracts, traditional procurement contracts, professional appointments, bonds, guarantees, collateral warranties, EPC (turn-key) contracts, O&M agreements, development agreements, agreements for lease, and funding agreements.

    • Acting for the developer of one of the largest private rental sector developments in Europe (circa £2 billion project). This has involved negotiating numerous building contracts, professional consultant appointments, parent company guarantees, payment guarantees, collateral warranties, novations, and performance bonds. The project is externally funded and has involved extensive negotiation with the funder’s lawyers to ensure drawdown of necessary funds as and when required (senior and mezzanine funding).
    • Acting for a number of international banks providing development finance for developments throughout the UK (typically funding developments with a project value between £20 million and £80 million).
    • Acting for the developer on the forward sale of a proposed new hotel, including drafting and negotiating the construction aspects of the forward sale agreement, development finance agreement, building contracts, professional consultant appointments, collateral warranties, and guarantees (circa £50 million project).
    • Acting for an investment fund acquiring a portfolio of recently developed and mid-construction assets throughout the UK. This involved extensive due diligence on the construction documentation, reporting on the same to the satisfaction of internal stakeholders and external lenders (circa £180 million project).
    • Acting for the owner (via administrators) of an amusement park undergoing extensive refurbishment prior to re-launch. The project was time critical with any delay potentially resulting in the company falling into liquidation. We therefore provided strategic advice on the procurement strategy and damages/incentive options to ensure the owner had the best chance of the project being delivered on time and on budget.
    • Advising a quasi-public body in regards to procuring a time-critical project using the Scape framework. The project ended up being Construction News’ Project of the Year (circa £30 million project).
    • Acting for a FTSE listed company acquiring new office premises and undertaking an extensive re-fit. Drafting and negotiating all the construction elements of the agreement for lease and all required construction documentation to satisfy the landlord’s requirements and protect the client’s interests (circa £10 million project).
    • Acting for the developer of a number of energy projects, including solar, anaerobic digestion, and wind. Drafting of all project documentation, including EPC contracts, traditional contracts, O&M contracts, direct agreements, bonds, warranties, and guarantees (circa £25 million project).
    • Acting for the developer of a number of student accommodation schemes, all separately funded via forward sale agreements (circa £40 million project).
    • Acting for an investment fund selling a number of recently developed retail parks in the UK, including negotiation of the construction elements of the sale contract and replying to construction enquiries to the satisfaction of the buyer’s various stakeholders (circa £40 million project).
