Magdalena Gad-Nowak is a senior associate in the Warsaw office. Her practice focus is on intellectual property (IP) law and cybersecurity and privacy regulations.

    Magdalena possesses a wide-range of experience in handling both copyright and trademark matters. In addition, Magdalena handles issues that relate to unfair competition, brand protection and methods of executing intellectual property rights for a variety of clients in different sectors.

    • Managing clients’ IP portfolio, handling copyright and trademark infringement, involved in IP litigation, counseling on trademark and copyright licensing transactions, conducting IP due diligence, handling domain disputes, in particular cybersquatting; applying for trademark registration and conducting opposition proceedings.
    • Conducting full-scale privacy and information security assessments, advising clients on managing risk and security; handling the consequences of data breaches, assuring domestic and international data compliance, advisory on international matters, notably trans-border data transfers within capital groups, assisting clients with compliance strategies and policies and developing data management policies.
    • Assisting US clients in structuring international privacy compliance schemes, in particular, compliance with the Polish and EU data protection regulations; drafting privacy notices as well as internal data protection documentation required under the Polish law (i.e. security policies); registering personal data files and DPOs with the Polish data protection authority and representing clients before it; and, most recently, assisting clients in the application of the GDPR.
    • Advising in a number of projects relating to implementation of IT systems (including issues related to licenses and service/maintenance).
    • Ongoing advisory on regulatory and transactional issues to media and broadcast clients (i.e. high-profile Polish commercial broadcasters).
    • Assisting clients from various sectors in connection with e-commerce and services supplied electronically (including consumer protection law advisory).
    • Advising in numerous M&A transactions, representing acquirers, targets, investment bankers and investors from different sectors (e.g. commercial broadcasting, telecommunication, cosmetic, insurance, banking, pharmaceutical industry; online selling platforms).
