Archana Gupta is a senior associate in the Pensions Practice based in our London office.

Archana’s experience is wide ranging and encompasses topical areas of pension law and queries relating to individual members of pension plans including mergers, buy-ins and buy-outs, guaranteed minimum pension equalisation, transfer regulations and the introduction of benefit options such as a bridging pension option, enhanced transfer value exercises and pension increase exchange exercises. She advises individual trustees and corporate trustees, as well as employers, regarding defined benefit and defined contribution arrangements.

  • Advising a £700 million pension scheme on the pensions implications of numerous corporate restructurings, often involving the negotiation of apportionment or withdrawal agreements. Advising the Trustees on their journey to buy-out, including a buy-in of benefits.
  • Advising the Trustee of a £2 billion regulated sector pension scheme on matters including member and employer queries, buy-out of some members’ benefits, the impact of legislation (such as the master trust legislation), rule amendments and regulatory compliance issues.
  • Advising on the restructuring of a business and the impact on the pension scheme.
  • Advising a £500 million pension scheme on day-to-day member queries and a change of administrators. Advising on a buy-in of all pensioner and deferred members’ benefits.
  • Assisting on a scheme rescue involving the pension scheme of a publicly funded private company that had gone insolvent, resulting in the scheme itself entering a pension protection fund (PPF) assessment period.
  • Advising numerous UK pension trustee clients on pooled fund documentation across all asset classes, including the negotiation of side letters, where appropriate. Recent experience includes advising on infrastructure funds, real estate funds and direct lending funds.
