Laura Hernández Rathe advises clients primarily on litigation and international dispute resolution matters. She also has experience with corporate, corporate finance and labor issues.

Laura’s experience with civil and commercial litigation procedures includes developing strategies for resolving disputes filed by and against clients, as well as appearing in court hearings on behalf of those clients. Laura also drafts motions and briefs related to complex civil and commercial matters and assists in identifying and collecting evidentiary material to be presented before the courts.

She also advises clients on the incorporation, integration and general operation of companies under Dominican law. Laura also performs due diligence, assists in collection procedures and represents clients in labor and employment disputes. 

Laura has completed multiple civil and commercial litigation programs. She also completed a program in “Leadership in Law” from Columbia University, and is completed a Master’s Degree in Civil Liability with the Pontificia Universidad Católica Madre y Maestra (PUCMM), jointly with the Université de Savoie, France. She  is a founding member of the first Association of Young Attorneys in the Dominican Republic (“ANJA” in Spanish).

  • Assisting in obtaining exequaturs in favor of foreign arbitral awards, pursuant to the recognition and enforcement of said arbitral awards in Dominican territory. 
  • Structuring of defenses, drafting of briefs, and appearing in Dominican civil and labor courts on behalf of numerous teams of major and minor baseball leagues in claims for breach of contract and damages. 
  • Assisting in litigation against international air carriers on civil liability, under the Dominican Civil Aviation Law and the Montreal Convention, the latter of which sets forth a special civil liability regime surrounding claims of this nature. 
  • Participating in litigation arising between distributors and foreign licensors, under Law No. 173 on the Protection to Importing Agents of Products and Goods, pursuant to which a special public policy regime in favor of local concessionaires is contemplated. 
  • Drafting of notices to defendants with domicile in Dominican territory in relation to claims filed in New York and other jurisdictions. 
  • Participating in the collection of securities, as well as the enforcement of precautionary measures pursuant to the recovery of millionaire debts. 
  • Assisting several air carriers in compliance matters before regulatory agencies, as well as their corresponding corporate updates before local governmental agencies. 
  • Assisting clients in completing corporate updates pursuant to a recently promulgated companies’ law. 
  • Assisting in the constitution of local commercial entities, as well as in the registration processes of foreign commercial entities before a variety of local governmental agencies. 
  • Assisting in the registration of intellectual property rights before the National Office of Industrial Property.
