Arohi Kaila is an associate in the International Dispute Resolution Practice Group. She has represented clients as part of large-scale construction and infrastructure projects.

    In 2016, Arohi successfully completed a six-month full-time secondment with John Holland, working on the new Perth Children’s Hospital project.

    Arohi has varied experience in the provision of construction and contracts advice, as well as adjudication applications and responses under security of payment legislation in Western Australia and the Northern Territory.

    She also has significant exposure in drafting construction contracts and conducting contract reviews, as well as back-end construction litigation. Further, she is familiar with various forms of dispute resolution, particularly arbitrations and expert determinations.

    Arohi also has expertise in various property, finance and regulatory matters, including corporate leasing, liquor licensing and regulatory matters.

    Arohi has been appointed as a committee member with the National Association of Women in Construction (WA Chapter) for 2018.

    • Acting for an electricity power generator company in Supreme Court proceedings arising out of the termination of a long-term power purchase agreement.
    • Providing ongoing advice to the head contractor in respect of the design and construction of the Forrestfield-Airport Link project.
    • Advising a major property group on claims against various contractors in connection with extensive defects in newly constructed office buildings.
    • Providing ongoing advice to the principal in relation to claims from the construction and development of a major community precinct in the Perth CBD.
    • Advising the principal on various disputes arising out of the construction of a major hotel in the Perth CBD.

    Secondment Experience

    • Worked closely with the general counsel, legal counsel and members of senior management on significant decisions as part of a high-profile construction project.
    • Assisted with the overall management and direction of protracted litigation, including liaison with internal personnel, external legal representatives, experts, barristers and other parties involved.
    • Drafted briefs, client correspondence (including notices of dispute, bank guarantees, defect notices and claims-related notices) and numerous legal documents.
    • Researched a wide variety of matters, including general commercial litigation, construction law and administrative law.
    • Assisted with ad hoc legal and strategic advice for optimal commercial outcomes.
    • Drafted submissions as part of various dispute resolution processes, including adjudications and expert determinations.

    Front-end Experience

    • Experience in drafting, reviewing and advising principals and contractors on various forms of contracts, including supply contracts and consultancy contracts, as well as construction for a diverse range of clientele.
    • Commercially focused advice on a range of construction and contract law areas, including liquidated damages, consequential loss, liability caps and termination provisions, as well as claims for extension of time, delay and disruption.
