Kelly Liu’s practice focuses on intellectual property, particularly in the areas of trademark and brand protection. She counsels in all aspects of trademark candidate selection, registrability search, application, prosecution, opposition, dispute, litigation and anti-dilution.

    She has experience in strategic planning for key marks for multinational company, having conducted numerous brand protection activities, such as initiating and attending administrative action against counterfeit, providing training to customs officers in different ports in China, as well as leading and monitoring anticounterfeiting action on different e-commerce websites.

    Kelly also has experience in advising on copyright, trade secret/know-how issues, including drafting and reviewing non-disclosure agreement and research agreements.

    She also provides legal advice in the field of product liability, especially for clients in the automobile industry. She has represented clients before arbitration commissions, as well as handled litigation.

    • Defending a European car company in a product liability case fraught with unfavorable evidence, by collecting background information on the plaintiff and using creative strategy.
    • Representing a European chemical company in a case against a former employee for theft of company information.
    • Advising a European luxury brand on brand protection strategy; implemented the brand protection strategy via registration of intellectual property rights at customs, conducting administrative raids, filing civil lawsuits, monitoring infringers’ IP portfolio and clearing up conflicting IP rights.
    • Overturning a group of decisions by the China Trademark Office regarding use of a trademark as generic term for a leading US chemical company.
