Ladislav Murin’s practice focus is on restructuring and insolvency, financial services, commercial litigation and regulatory matters.

Ladislav’s experience includes representing and advising Czech and foreign creditors (financial institutions, suppliers, buyers, etc.) as creditors and insolvency petitioners in various insolvency proceedings commenced with Czech and foreign debtors and their representation in various insolvency-related court disputes. Ladislav’s experience also includes representing and advising creditors in complex debt restructuring deals and representing and advising Czech and foreign clients (insurance companies, investment funds, manufacturers, employers, etc.) in various domestic litigation disputes.

Ladislav has advised clients on a broad range of insolvency-related issues, such as the enforceability of close-out netting arrangements in the Czech Republic, debtor’s liability and an insolvency petitioner’s liability. Ladislav has also advised clients on a large range of regulatory issues, such as producer responsibility obligations, regulation of providing ATM services and waste collection regulation in the Czech Republic.

Ladislav is the co-author of the Commentary to the Insolvency Act (in Czech) and is a member of INSOL Europe.

Restructuring and Insolvency

  • Representing a Czech bank in insolvency proceedings against a major Czech air carrier, including representation on the creditors’ committee.
  • Representing and advising a Czech creditor in an insolvency proceeding against a Russian-owned Czech bank.
  • Representing and advising a major Czech financial institution as an insolvency petitioner and chairman of the creditor’s committee in an insolvency proceeding in which one of the first extraordinary moratoriums was used (unlawfully) by a debtor.
  • Representing and advising a Czech creditor in insolvency proceedings against three Czech-based clothing manufacturers and distributors.
  • Representing and advising a major Czech financial institution in an insolvency-related court dispute concerning its right to block the debtor’s bank accounts.
  • Advising a Czech investor in a distressed asset acquisition of an unfinished hospital building.
  • Representing and advising a Czech creditor and insolvency petitioner in an insolvency proceeding against a foreign debtor concerning its establishment in the Czech Republic.
  • Representing and advising a US corporation in an insolvency proceeding commenced with one of its major Czech suppliers.
  • Advising a Korean corporation on matters of Czech insolvency law in its dispute with a Czech debtor before a Korean arbitration court, and representing and advising it in the insolvency proceedings subsequently commenced with the debtor.
  • Representing and advising a Singaporean corporation in an insolvency-related court dispute concerning its claim for the return of unjust enrichment on the side of the debtor’s insolvency estate.
  • Representing and advising an investment group as a creditor in a complex CZK400 million financing scheme with an increasingly difficult debtor. 
  • Preparing a legal opinion on the enforceability and insolvency-related aspects of close-out netting arrangements in the Czech Republic for global energy traders.

Litigation

  • Representing a major US manufacturer and distributor of automotive oils, additives and lubricants in a complex cross-border court dispute with its customer dealing with supply chain issues from various EU and non-EU markets and jurisdictions.
  • Representing a former board member in Czech court proceedings initiated by a major mining company alleging claims for damages against the client of a significant financial value.
  • Representing a Czech subsidiary of a global group of companies providing ground-handling, cargo-handling, fueling and related airport services in labour court proceedings.
  • Representing a supplier of electricity and natural gas to the Czech market in a series of court proceedings regarding a dispute between a majority shareholder and an alleged minority shareholder in a market-leading company.
  • Representing a Czech entity belonging to a global group of companies involved in the manufacture of various types of roofing solutions in a court dispute against a former executive director for the protection of the company’s reputation.
  • Representing and advising an insurance company in various court disputes concerning the liability for personal injury and property damage. 
  • Representing and advising a client in a complex real estate dispute concerning the payment of a CZK25 million advancement. 
  • Representing and advising a US internet domain registrar in a dispute concerning its potential liability for content posted by the registrant that potentially infringed upon the personal rights of a Czech party.
  • Representing and advising a client in a court dispute concerning the scarcely used pre-contractual liability for the refusal of the counterparty to enter into an agreement.

  • Advising a major global lender and financier as a local Czech counsel in a complex M&A transaction.
