As an associate of our firm, Isabella Mosole has gained legal experience within a variety of areas, including planning and development approvals, property acquisitions, corporate leasing, environmental, regulation, local government practice and liquor licencing in both advisory and litigious capacities.

    In 2018 Isabella undertook a secondment with the Department of Planning, Lands and Heritage assisting with the state government’s reform of the WA Planning System.

    Isabella has strong ties with the Northern Territory and has assisted both commercial clients and the NT government in respect to litigation, real estate and environmental matters.

    Isabella is involved with a number of research initiatives, including monitoring issues surrounding the deployment of autonomous vehicles and Australia’s emerging build-to-rent market.

    Litigation and Administrative Law

    • Assisting with a contentious liquor licensing application involving third-party objections and proceedings in the Northern Territory Liquor Commission.
    • Assisting with a large-scale discovery in the Northern Territory Supreme Court.
    • Day-to-day conduct and file management (under supervision) of Supreme Court proceedings on behalf of local residents to challenge the incorrect procedure followed by a local government to dispose of its land under a long lease arrangement.

    Environmental, Energy and Natural Resources

    • Assisting with the preparation of strategic advice and submissions n respect to the:
      • Classification and reporting of contaminated sites, under the Contaminated Sites Act 2003 (WA).
      • Compliance and regulation of fisheries under the Environmental Protection Biodiversity and Conservation Act 1999 (Cth).
      • Transfer process for mining tenements and associated environmental approvals for mining operations in the Northern Territory and Western Australia.

    Planning and Development

    • Assisting with the preparation of strategic and practical advice on a variety of issues arising under the Planning and Development Act 2005 (WA), including the applicability of the deemed to comply provisions of the R-codes, land zoning and height restrictions within the Canning Bridge Activity Centre and City of South Perth (respectively).
    • Secondment to the Department of Planning, Lands and Heritage to assist with the review of the WA Planning System. This role included assisting with the preparation of a Green Paper, meeting with key stakeholders, including local government and commercial representatives, analysis and drafting of legislative changes required to implement to reforms being considered.
    • Assistance in Supreme Court proceedings to challenge the approval of a residential development in South Perth that did not comply with scheme requirements.
    • Assistance in Supreme Court and Court of Appeal challenges to a development approval for a secondary shopping precinct in Busselton, granted contrary to the City of Busselton’s local planning scheme.
    • Assisting to prepare law reform and policy submissions on various state planning policies, local government planning schemes and planning instruments.

    Local Government and Regulatory (General)

    • Assisting with the preparation of strategic and practical advice in respect to:
      • Australian product and food labelling requirements
      • Australian sanctions regimes in respect to selling or delivering goods to particular countries that are the subject of United Nations Security Council resolutions
      • Anti-bribery and Corruption (ABC) obligations in Australia and reviewing related policy documents, including code of ethics, ABC policies and employee handbook
      • Local government CEO in respect of Department of Local Government authorised inquiry
      • Australian ticket resale market

    Real Estate and Commercial (General)

    • Assisting with the preparation of strategic and practical advice in respect to:
      • Adverse possession claims
      • Obligations, rights, entitlements and disputes under commercial contracts and leases
      • Applications for liquor licences
      • Foreign Investment Board Approval
      • Regulatory compliance with ASIC
    • Drafting various commercial agreements (sale, supply and distribution), deeds, leases, licences, terms and conditions, privacy and whistle-blower policies and website user agreements.
