Denée’s experience encompasses a broad range of corporate and commercial litigation matters with a particular emphasis on breaches of the Corporations Act, misleading and deceptive conduct claims, claims in relation to financial advice, structured financial products and financial product credit ratings, and apportionment issues. Denée acts for a wide range of clients in large complex commercial disputes, class actions in the Federal Court of Australia and commercial settlements.

    • Acted for 12 local government councils which successfully brought claims against Standard and Poor’s, ABN Amro Bank NV and Local Government Financial Services in relation to credit ratings issued to a complex structured financial product acquired by the councils. Those proceedings are the first time Standard and Poor’s has ever been held liable for its credit ratings anywhere in the world. Denee also acted for the Councils in successfully defending the respondents’ appeal in the Full Court of the Federal Court of Australia. 
    • Acting for private investors, local government Council and charities in proceedings against the Commonwealth Bank of Australia in relation to claims regarding financial advice and disclosure obligations and in relation to Court approval of a global settlement for investors.
    • Acting for private investors, charities and local government councils in further proceedings against Standard and Poor’s in relation to credit ratings issued to synthetic collateralized debt obligations in Australia.
    • Advises in relation to claims in Europe and the UK in relation to credit ratings of structured financial products.
    • Acted for Muswellbrook Shire Council in successfully bringing a novel application seeking access to information regarding the identity of group members in open class representative proceedings.
    • Acted for five investors in claims against Oakvale Capital Limited (Subject to a Deed of Company Arrangement) in relation to financial product advice.
    • Advised class of creditors in the administration and liquidation of Lehman Brothers Australia Limited.
