Matthew Mulqueen is a partner located in Squire Patton Boggs’ offices in the UK and Houston, Texas, where he practices as an English law qualified non-contentious construction and engineering lawyer with a focus on major energy and infrastructure projects in the emerging markets. 

His practice concentrates on dealing with the key project documents in energy and infrastructure transactions, including power purchase agreements, implementation agreements, turn-key EPC contracts, equipment supply and installation agreements, operation and maintenance contracts, lender direct agreements, performance bonds, guarantees and other related documentation. Matthew has worked on a wide range of large renewable energy, oil, gas and infrastructure projects worldwide.

Renewable Energy

  • Advising Vestas Wind Systems in relation to their involvement in the 310MW Lake Turkana Wind Power Project in Kenya; awarded African Renewables Deal of the Year at the IJGlobal Awards 2014 Europe & Africa and by Thompson Reuters Project Finance International.
  • Advising a joint venture on the terms of the EPC contracts and other related construction and maintenance agreements for the development of roof top PV projects in the UK. 
  • Advising in relation to the Wind for Prosperity project which aims to introduce an innovative, commercially-based business model to bring affordable and reliable hybrid power generation to rural populations.
  • Advising lenders in relation to a 165 MW Amaila Falls hydropower project in Guyana.
  • Advising in relation to the development of a ground mounted Solar PV project in the UK.
  • Advising on six onshore wind farm projects in Round 4 of the South African renewable IPP program, including: 
    • Oyster Bay Wind Farm (142 MW);
    • Karusa Wind Farm (142 MW); 
    • Soetwater Wind Farm (139 MW);
    • three further wind farm developments (indemnity confidential) of 130+ MW, 100+ MW and 30+ MW.
  • Advising lenders and developers in relation to the EPC contracts and associated long term service agreements and other ancillary agreements, for the: 
    • 300 MW Tarfaya onshore wind farm in Morocco;
    • 150 MW Taza onshore wind farm in Morocco;
    • 160 MW Ustka onshore wind farm in Poland;
    • 34 MW Jedrzychowice onshore wind farm in Poland; 
    • 50 MW onshore wind farm in Uruguay. 
  • Advising on six onshore wind farm projects in Rounds 2 an 3 of the South African renewable IPP program: 
    • West Coast 1 (94 MW); 
    • Tsitsikamma Community Wind Farm (95 MW); 
    • Nojoli (88 MW); 
    • Waainek (23 MW); 
    • Grassridge (60 MW); 
    • Chaba (21 MW).
  • Advising developers on a solar PV project in Round One of the Direct Proposal Submission process in Jordan. The project was one of the so-called “Seven Sisters” solar projects which were awarded Middle Eastern Renewables Deal of the Year and Overall Deal of the Year at the IJGlobal Awards 2014. 
  • Advising in relation to the drafting and negotiation of numerous supply and install contracts, associated long term service agreements and other ancillary agreements for projects in various jurisdictions including Croatia, Belarus, Serbia and on the islands of Curacao and Aruba in the Netherland Antilles.
  • Advising equity investors in relation to a combined energy from waste and gas to grid facility in the UK.
  • Advising in relation to the construction contracts, long term service agreements and other ancillary agreements for the following offshore wind farms: 
    • 576 MW Gwynt Y Môr offshore wind farm, UK;
    • 560 MW Dudgeon offshore wind farm, UK;
    • 330 MW Bligh Bank offshore wind farm, Belgium awarded Infrastructure Journal's Renewables Deal of the Year for 2009; 
    • proposed 30-50 MW extension of the Kentish Flats offshore wind farm, UK.
Oil and Gas
  • Advising on the construction of an offshore mooring and oil transfer system together with associated onshore storage facility, Ghana.
  • Advising on the construction and engineering documents for the development of:
    • a SAGD oil sands extraction and processing project in Alberta, Canada.
    • platforms for two major heavy oil fields, offshore UK North Sea.
    • an FPSO in relation to a major field off the coast of Brazil.
    • a floating jack-up drilling rig for use in various locations globally.
  • Advising a multinational oil and gas company on the drafting of a new suite of EPC contract documents for use in onshore and offshore procurements outside of Norway.
  • Advising the developer on the terms of a set of construction documents in relation to an Olefins complex, Russian Federation.
  • Advising on the terms of a set of construction documents in relation to the development of a petrochemical complex in the Republic of Azerbaijan.
General Power
  • Advising on the procurement and construction arrangements for up to 6 GW of new nuclear power plants in the UK including the drafting and negotiation of appointment of the various consultants, early works agreements, the documentation for the tender process for the choice of technology vendor, FEED agreements, stage agreements, preferred vendor arrangements and EPC contracts.
  • Advising the developer in relation to the EPC Contract and associated long term service agreement for the 850 MW combined cycle gas turbine plant in Turkey.
  • Advising a developer in relation to a planned 300 MW extension of an existing CCGT power plant in the UK.
Infrastructure
  • Seconded for 12 months to the Olympic Delivery Authority legal department, the government authority responsible for investing more than £9.3 billion in the infrastructure assets required for the staging of the Olympic Games in London in 2012. Advised on: 
    • the Velodrome building and associated BMW facility (winner of the 2011 Royal Institute of British Architects Stirling Prize for Architecture);
    • the construction, operation and maintenance of all construction roads across the Olympic Park site;
    • the construction of the temporary and permanent utilities required to be installed across the Olympic Park for use during the construction phase of the Olympic project.
  • Advising lenders in connection with the construction of the deep water London Gateway Port development, UK, including in relation to EPC Contracts for the construction of the 2,700 meter container quay and associated infrastructure together with marine dredging contract.
  • Advising in relation to the redevelopment of Greenwich Peninsula, London.
  • Advising on the construction contracts for their development of the 55 storey Lumiere Tower in Leeds comprising of 650 apartments, 20,000 sq. ft. of retail space and 10,000 sq. ft. of office space.
  • Advising at developer level in relation to various university accommodation developments in the UK.
