Nisha Patel is an associate in our Palo Alto office whose practice focuses on labor and employment matters.

    Nisha defends employers in state and federal wage and hour class actions involving allegations such as misclassification/exemption, meal and rest break claims, off-the-clock work, failure to reimburse for business expenses, rounding, overtime claims and wage statement claims. She also defends employers in single plaintiff and other complex employment litigation matters involving claims of discrimination, harassment, retaliation, wrongful termination, trade secret misappropriation, unfair competition claims, and breach of contract claims.

    She is experienced in all areas of litigation, such as developing and implementing case strategy, investigating allegations, interviewing witnesses, managing discovery, drafting, opposing and arguing motions, and achieving desired settlements. Nisha has assisted on successfully defeating class certification and obtaining summary judgment in collective and class actions. She also has particular expertise in litigating PAGA representative actions.  

    In addition to defending employers in litigation, Nisha provides advice and counseling to employers on a day to day basis in all areas of local, state and federal employment law, including employment policies and procedures, wage and hour compliance, reviewing and drafting agreements, separations, leaves of absence, and manager and employer training.

    Nisha received her J.D. from the University of Southern California where she was a Legal Writing Teaching Fellow, a member of the Southern California Law Review and a Judicial Extern for the Honorable Margaret M. Morrow of the US District Court, Central District of California.
