Nicola Phillips undertakes a large variety of commercial disputes work and has vast experience of High Court litigation as well as alternative dispute resolution.

    Nicola specialises in acting for banks, asset based lenders and other financial institutions in worldwide and UK fraud investigations, asset recovery actions and bringing claims under guarantees, indemnities and warranties. Nicola’s practice also includes advising on general contractual disputes, employee fraud claims, defamation, breach of confidence, IT disputes, professional negligence and agency disputes and her client base in this regard is extremely varied, ranging from entrepreneur led, sole trader businesses to large multinationals.

    Nicola has recently completed a secondment to Aon Law, working on pension dispute cases advising the Scheme Administrators and the Trustees.

    • Acting for invoice discounter to successfully enforce Indemnities in reported decision of ABN Amro Commercial Finance PLC v McGinn and others [2014] EWHC 1674 (Comm).
    • Defending section 68 Challenge pursuant to the Arbitration Act 1996 to preserve client’s rights to receive contractual damages in excess of £3 million.
    • Acting for a large financier in relation to a £20 million fraud claim against the directors of a customer to whom the financier provided finance and stock facilities. This involved obtaining freezing injunctions and a search order against the relevant individuals.
    • Acting for a discounter in substantial claims against fraudulent director which involved obtaining a worldwide freezing injunction order.
    • Acting for a discounter on large fraud involving complex web of companies, cross firing of monies and payments to offshore jurisdictions.
    • Acting for national client in respect of a series of unrelated employee frauds to recover losses sustained.
