Madelaine is an associate in the International Dispute Resolution Group based in Dubai. She is an English qualified barrister with full rights of audience before all English courts and the DIFC Court. Before joining the firm, Madelaine practiced at the bar in London and at leading law firms in Dubai and Oman.

    Madelaine advises on a range of disputes in both the arbitration and litigation arenas in the areas of construction and commercial law. Her experience includes advising on the merits of and conducting arbitration proceedings governed by the DIAC, ICC, DIFC-LCIA, ADCCAC rules and ad-hoc arrangements.

    The jurisdictional reach of Madelaine’s practice includes the UAE, DIFC, Oman, Qatar and KSA.

    She has a particular interest in the interplay between the onshore courts and international arbitration proceedings, including making applications for interim measures, attachment orders, challenges to awards and enforcement under the New York Convention.

    Construction Arbitration/Litigation

    • Representing a global architect in a DIAC arbitration in respect of breaches of confidentiality and non-compete provisions following substitution.
    • Representing a government entity in an ADCCAC arbitration concerning disputed variation claims.
    • Represented a Korean global construction company in ICC proceedings concerning delay and disputed variations. Drafted skeleton argument for legal application to prevent disclosure of state owned confidential information within the proceedings.
    • Drafted witness statements and advised a government-owned entity in a US$50 million ICC Qatari law and seated arbitration concerning suspension and termination of an EPC contract.
    • Advised a subcontractor in a DIAC Dubai-seated arbitration against a Dubai Government-linked entity.
    • Represented government entity employer in ad hoc proceedings under the Oman Arbitration Law related to the cancellation of an electricity project.
    • Advised an airport authority in various disputes associated with the construction of a new terminal.
    • Drafted and presented submissions to an expert concerning a US$7.5 million dispute before the local court in respect of Oman’s largest aluminum rolling mill.
    • Settled local court pleadings on behalf of a global developer for the recovery of OMR 2.5 million owed following the construction of Oman’s largest golf course.

    Commercial Arbitration/Litigation

    • Advising on the availability of interim measures and attachment orders in relation to DIAC proceedings for breaches of personal guarantees.
    • Advised in an LCIA arbitration related to breaches of warranties and indemnities following a share purchase in KSA.
    • Represented an international bank in breach of trust proceedings in respect of US$6.2 million up to the Supreme Court in Oman.
    • Provided various debt recovery advice and managed litigation through local courts on behalf of banks/companies/contractors, including enforcement issues.
    • Advised a contractor on Saudisation and supply of foreign workers from a third party in KSA.
    • Advised a global technology company on their lease dispute against a government-owned entity and prominent landlord.

    DIFC Court

    • Drafted an application, skeleton argument and supporting material for an ex parte injunction to prevent the calling of a performance bond under UAE law in the DIFC Court.
    • Drafted grounds of appeal and a skeleton argument for a permission to appeal a decision on a jurisdictional challenge and alternative service order to the DIFC Court of Appeal.
    • Advised on the enforcement of an English High Court judgment in the DIFC Court under the Memorandum of Guidance.
