Emma Salkavich has extensive, high-level commercial disputes experience, acting for blue-chip companies in Australia in a range of areas.

Emma brings a fresh, commercial and pragmatic approach to each individual dispute she works on, to help clients achieve solid outcomes in often complex situations.

Emma has acted for clients in courts of all levels. Most of Emma’s commercial litigation experience is in the various Supreme Courts (NSW, NT, Vic, WA), and in the Federal Court of Australia.

An Accredited Specialist in Dispute Resolution, Emma also enjoys resolving disputes outside of court, through arbitration, expert determination and mediation.

Emma has industry, in-house experience, including having worked as senior legal counsel for an international health services company.

  • Assisting an Australian construction contractor to prepare for an international commercial arbitration in Singapore arising out of the Ichthys Cryogenic Tanks Construction Project in the Northern Territory.
  • Acted for an energy company in an expert determination before a former High Court judge concerning a dispute over the calculation of a supply tariff under an energy supply contract.
  • Supported (as in-house lawyer) an international health services company through two multiparty class actions in the Supreme Court of Victoria. The third-party claims against the company were based in negligence. Both class actions successfully resolved without recourse to final hearing.
  • Acted for BHP Billiton in a tax dispute worth more than AU$2 billion, which resulted in a successful outcome for the company. Instructed senior counsel at the hearing in the Federal Court of Australia.
  • Assisted Leighton Contractors Pty Ltd, as it was then, to manage various commercial and construction-related disputes (while on secondment).
  • Acted for numerous companies in safety prosecutions and coronial inquiries in different jurisdictions in Australia.
