Darin J. Smith is a member of the firm’s Environmental, Safety & Health Practice Group and focuses his practice on helping organizations manage and mitigate the spectrum of financial and reputational liabilities that may arise from a crisis no matter the size, type or location. He has assisted clients in all stages of crisis management, from emergency preparedness to public relations to litigation and settlement negotiations.

    Darin also specifically counsels clients on a wide range of environmental liability issues relating to the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), Resource Conservation and Recovert Act (RCRA), Clean Water Act (CWA), National Environmental Policy Act (NEPA), Endangered Species Act (ESA) and Oil Pollution Act (OPA). His experience includes negotiating with numerous federal agencies, including the Environmental Protection Agency (EPA), US Fish & Wildlife Service (FWS), National Park Service (NPS), Bureau of Ocean Energy Management (BOEM) and Bureau of Safety and Environmental Enforcement (BSEE).

    Darin also has broad experience with the Foreign Corrupt Practices Act (FCPA), in particular assisting organizations with complex internal investigations to satisfy US and international reporting requirements.

    • Advising a Canadian client on an international CERCLA liability matter, including all stages of trial preparation, appellate motions practice, strategic communications and government relations.
    • Assisting with the development, implementation and completion of internal investigations for two Japanese companies and managing a team of multilingual document review staff.
    • Counseling a consortium of Japanese companies with FCPA, litigation, contractual and other related liabilities associated with the Operation Car Wash scandal in Brazil.
    • Providing multifaceted support for a multimillion dollar civil lawsuit with media implications involving a community college school district in California.
    • Helping a mining client obtain all appropriate and proper permitting from the NPS and FWS for a multistate soil sampling program to satisy EPA directives.
    • Counseling a US subsidiary of a multinational conglomerate on CWA issues in the Gulf of Mexico, including negotiations with EPA, BOEM and BSEE.
    • Assisting a Texas university system with its bid for the operation and management of the Los Alamos National Laboratory, including acting as Secretary for the overall Project Steering Committee.
    • Advising a Japanese company on all aspects of an oil and gas investment in the Gulf of Mexico, with particular focus on multinational compliance, corporate veil and privilege issues.
    • Assisting an international oil and gas company manage a plant explosion and fire in Venezuela, including media relations and social media monitoring.
    • Advising a Japanese client in managing the bidding process with six construction companies to improve a semiconductor manufacturing plant in Japan.
    • Assisting numerous organizations draft, update and finalize a variety of crisis management and emergency response plans.
