Magdalene Thompson is an associate in the Construction & Engineering team in our Birmingham office. Magdalene has over six years' experience working in the construction and engineering market, as well as in the insurance market. She has handled professional negligence claims on behalf of various professionals with a particular focus on architects, surveyors, engineers, consultants, estate agents, contract administrators, etc.

    Magdalene has also gained first-hand experience of providing detailed guidance to policy holders on non-contentious construction and data protection contracts while on secondment at an insurance broker. Similarly, Magdalene has gained first-hand experience with managing and advising on professional and financial claims while on secondment at a market-leading global insurance company.

    Magdalene has proven experience in dealing with a variety of claims arising from directors and officers and regulatory matters. She also advises upon policy coverage issues.

    • Defended an architect and contract administrator in relation to the alleged negligence of the enlargement of an existing London hotel basement area, the demolition of the existing first floor area and the construction of a vertical two-storey extension, resulting in an alleged loss of circa £1.3 million.
    • Defended a circa £850,000 claim against a structural engineer in relation to substantial cracking appearing on an extension to the property and failure to conduct reasonable assessments to obtain the completion certificate.
    • Defended a client following the alleged failure to identify cracking in the truss rafters, which resulted in the structural inadequacy of the property.
    • Drafted appointments, bespoke contracts, duty of care agreements and collateral warranties for a variety of professionals in relation to multimillion-pound projects.
    • Assisted with a £15 million dispute relating to the failure to heat soak panes of glass resulting in the fracture and the falling of the glass on to the below street.
    • Advised on media and cyber schemes in relation to various claims, including copyright infringement, improper use of a company website and an alleged breach of the terms and conditions by downloading illegal and unsupported data during COVID-19.
    • Advised an international client on a data breach caused by a ransomware attack and dealt with a volume of escalation queries from customers, employees and former employees.
    • Defended solicitors in relation to advice provided on ground rent provisions resulting in a loss of circa £1 million and the implications of the CML 2017 guidance.
    • Managed a residential management client scheme in relation to the alleged negligent handling of various properties, including failure to obtain rent arrears, providing incorrect tax advice, failure to remove defective cladding and failure to attend to common areas, thus resulting in injury.
