On 7 December 2022, the European Commission (EC) announced plans to harmonise insolvency proceeding rules across the 27 EU member states. Although harmonisation of insolvency legislation across the EU is not a new objective for the EC, the EC has now published a draft proposal for a directive to harmonise certain aspects of insolvency law. In this insight, we explain what is proposed and consider the detail around the proposals.
