Unlooping the Closing Loopholes Bill 2023

On 4 September 2023, the Australian federal government introduced the Fair Work Legislation Amendment (Closing Loopholes) Bill 2023 (Bill), its third tranche of amendments to the Fair Work Act 2009 (Cth) (FW Act) and associated legislation. The Bill proposes major changes with respect to the regulation of:

  • Casual Employees
  • Independent Contractors
  • Labour Hire
  • Wage Theft

The Senate Education and Employment Legislation Committee’s reporting date for an inquiry into the Bill has been set for 1 February 2024, and the reintroduction of the Bill into the Senate is anticipated to follow soon after.
