Emily Davis is an associate in the Restructuring & Insolvency Practice Group based in the Birmingham office. Emily trained with the firm in our Leeds office and relocated to Birmingham in 2022. Emily has a primary focus on non-contentious restructuring, acting for banks, lenders (including asset-based lenders), insolvency practitioners, corporates, distressed investors and other key stakeholders.

Emily has experience of all aspects of asset based lending, distressed lending, accelerated corporate disposals, restructuring and security reviews.

Emily has been described by clients as "energetic, proactive and supportive”, “an excellent technical lawyer" and someone who "commands the respect of the client on calls and in meetings".

Emily was highly commended in the Young Lawyer of the Year category at the Insider Midlands Young Professionals Awards 2024.

  • Acting for lenders to review their security documentation, highlight deficiencies and suggest solutions and security enhancement where appropriate.
  • Advising lenders in distressed recovery situations to advise on the most appropriate enforcement avenues and assist lenders to achieve the best return as efficiently as possible, adopting a pragmatic approach to finding solutions.
  • Implementing various restructures and refinances structures, for companies and lenders, including asset-based lenders.
  • Emily's insolvency background allows her to advise lenders on deals with a focus on maximising recoveries in a distressed scenario. An example of this is Emily's work on the lending and subsequent recoveries for the lender to the Smiffys fancy dress company.
  • Acting for all major national and international insolvency practitioners on the sale of numerous businesses and assets in administration, as well as providing ongoing advice on various issues throughout the insolvency process. Notably, Emily acted for administrators from Interpath Advisory on the trading administration and subsequent sale of the business and assets of the Slack & Parr group, which included disposals of US and Chinese subsidiaries.
  • Acting in relation to failed domestic energy suppliers, including guiding those companies through Ofgem’s “Supplier of Last Resort” process and advising directors in connection with an energy special administration.
