Stephen Fazio focuses his practice on domestic US litigation, as well as international arbitration on behalf of clients in the automotive, energy and chemicals industries. In the US, Stephen represents clients in complex products liability, mass tort and commercial disputes before state and federal courts. Stephen has extensive experience in complex multidistrict and class action litigation.

Stephen’s international commercial arbitration experience includes serving as counsel to energy companies in disputes concerning the supply of natural gas and liquefied natural gas (LNG) in arbitrations under the International Court of Arbitration (ICC) and the London Court of International Arbitration (LCIA) rules. He also has significant experience in investment treaty arbitrations under the United Nations Commission on International Trade Law (UNCITRAL) arbitration rules.

Stephen is active in the pro bono community and has served on the board of directors and on the executive committee of the Legal Aid Society of Cleveland, including serving as board president in 2022. He currently serves on the board of directors of the Legal Aid Society of Northeast Ohio.

Stephen has also served as a deputy practice group leader (Litigation) and currently serves on the firm’s nine-member Ethics and Professional Responsibility Committee.

US Litigation

  • Representing a luxury German auto manufacturer as coordinating counsel for products liability claims across North America.
  • Serving as trial counsel to an auto manufacturer in a products liability case involving a post-collision fire resulting in multiple fatalities and serious injuries. Following a five-week jury trial, obtained a complete defense verdict.
  • Representing a major chemical manufacturer in a 3,500+ plaintiff multidistrict litigation involving claims that drinking water allegedly contaminated with perfluorooctanoic acid (PFOA) resulted in serious personal injury. Served in all aspects of the defense, including as trial counsel in the first two bellwether trials.
  • Defending a major chemical manufacturer against claims by the state of Ohio that release of PFOA resulted in significant natural resource damages within the state.
  • Representing a major petrochemical company in multidistrict litigation in Texas state court in which 48,000 plaintiffs alleged injuries resulting from refinery flaring activity. Client obtained a jury verdict in its favor following a month-long bellwether trial.
  • Defending a plumbing fittings manufacturer against claims of unlawful tying and monopolization under federal antitrust law by a competitor and defending related class action claims by allegedly impacted consumers.
  • Defending niche software providers in matters alleging monopolization, attempted monopolization, tying and unfair competition.
  • Defending a major steel manufacturer in class action litigation involving claims of nuisance and trespass for the facility’s operations.
  • Defending a major petrochemical company in class action litigation involving claims of environmental damage and fraud. The client obtained a complete defense verdict after a 17-week jury trial.

International Arbitration

  • Representing an Italian-based energy company in an LCIA arbitration concerning a supplier’s wrongful delay to provide LNG under a long-term sale and purchase agreement.
  • Representing an Italian-based energy company in three separate ICC arbitrations concerning the pricing of natural gas or LNG resulting in arbitral awards and settlements exceeding €950 million.
  • Representing a Spain-based energy company in an ICC arbitration concerning the price paid under a long-term LNG purchase agreement.
  • Representing a group of investors in an international arbitration under UNCITRAL arbitration rules involving claims arising under the bilateral investment treaty between the Russian Federation and Mongolia.
