Jakub Kamenický is of counsel in our International Dispute Resolution Practice. Jakub’s practice focuses on international and domestic dispute resolution, including investor-state and commercial arbitration.

Jakub’s experience includes drafting substantive and procedural submissions, work on assessments of prospective claims and strategy, as well as representing clients at hearings. Jakub advised clients in several complex commercial and investment arbitration matters under the rules of the International Centre for the Settlement of Investment Disputes (ICSID), the International Chamber of Commerce (ICC), and the United Nations Commission on International Trade Law Rules (UNCITRAL).

In addition to his experience with investment treaty arbitrations, Jakub routinely acts for clients in internal investigations concerning international financial regulations, international economic sanctions, anti-money laundering (AML), and international criminal law.

Jakub teaches a full semester course on international arbitration at the Faculty of Law of the Comenius University in Bratislava.

Investment Treaty Arbitration Experience

  • Representing the Slovak Republic in an ICSID arbitration initiated by Discovery Global LLC, a US exploration company, arising under the US-Slovakia BIT in connection with an alleged expropriation claimant’s investment in oil and gas exploration in the Slovak Republic. (ICSID Case No. ARB/21/51)
  • Secured a full victory for the Republic of Kosovo in an investment arbitration conducted under the ICC rules initiated by Mr. Blerim Devolli. The dispute related to investment in the telecommunications sector.
  • Secured a full victory for the Republic of Kosovo in an investment arbitration conducted under the ICC rules, initiated by Mr. Bedri Selmani. The dispute was related to an alleged investment in a chain of petrol stations in Kosovo.
  • Secured a full victory for the State of Libya in an investment arbitration filed by two French nationals under the France-Libya BIT and the UNCITRAL Rules.
  • Secured a full victory for Croatia in an ICSID arbitration brought by a German national in a dispute concerning ownership of real property allegedly purchased during the war of independence in the 1990s.
  • Representing the State of Turkmenistan in a pending ICSID arbitration brought by a foreign investor concerning the construction of grain production facilities and bakeries.
  • Advising the State of Libya in a pending €52 million arbitration relating to several construction projects filed by the company Nurol Insaat ve Ticaret before the ICC under the Turkey-Libya BIT.
  • Advised Canadian and Cyprus investors in a pending ICSID arbitration against Serbia regarding expropriation of an agricultural company. The claimed amount exceeds €80 million.
  • Defended the Slovak Republic in an almost €170 million UNCITRAL arbitration arising under the Poland-Slovakia BIT in connection with an alleged indirect expropriation of a company producing mineral water. In 2020, the Tribunal rejected all of the investor’s claims for damages. (PCA Case No. 2017-08).

Commercial Arbitration

  • Represented a major Czech and CEE group involved in aluminium, metallurgical and machinery industries in an ICC arbitration against a designer of industrial machines.
  • Represented a Slovak industrial company in an ICC arbitration against one of its major automotive customers.

International Criminal Law

  • Representing the former President of Kosovo, Hashim Thaci, in the case of Prosecutor v. Hashim Thaci, et al., pending before the Kosovo Specialist Chambers in The Hague.
